TERMS AND CONDITIONS OF THE PROMOTIONAL CAMPAIGN
‘24 free’

 

§ 1. Organiser and subject of the Promotion

1. The organiser of the promotional campaign entitled “24 free” (“the Promotion”) is VOLTRUSH Sp. z o.o., with its registered office at 176/178 Belzacka Street, 97-300 Piotrków Trybunalski, entered in the Register of Entrepreneurs of the National Court Register under KRS number 0001172024, NIP: 7712937818, REGON: 541681231 (“Organiser”).

2. This promotion relates to the VOLTRUSH powerbank hire service provided via the VOLTRUSH mobile app (“App”) (“Service”).

3. The Promotion is a closed promotion and is aimed exclusively at selected users of the App to whom the Organiser has individually granted the right to take part in the Promotion in accordance with the terms set out in these Terms and Conditions (“User”).

4. These Terms and Conditions set out the specific rules for using the Service as part of the Promotion. In matters not covered by these Terms and Conditions, the terms and conditions governing the provision of the VOLTRUSH Service applicable to the User (“Service Terms and Conditions”) shall apply.

§ 2. Promotion Period

1. The entitlement to take part in the Promotion may be exercised during the period from 14 August 2026 at 00:00 until 20 August 2026 at 23:59 (‘Promotion Period’).

2. The Promotion is activated upon the User successfully renting a powerbank covered by the Promotion during the Promotion Period.

3. The Promotion entitles the User to a one-off, free rental of one power bank for up to 24 hours, during which the User may use the power bank without incurring any rental charges, in accordance with the terms set out in these Terms and Conditions (‘Free Usage Period’).

4. A Free Usage Period commenced during the Promotion Period may end after 20 August 2026.

5. If the User does not rent a powerbank during the Promotion Period, their entitlement to take part in the Promotion will expire at 23:59 on 20 August 2026 and cannot be used at a later date.

§ 3. Conditions of participation in the Promotion

1. A User is eligible to take part in the Promotion if they meet all of the following criteria:

1. have an active account on the App;

2. have been selected by the Organiser to take part in the Promotion;

3. have received a push notification via the App informing them of the opportunity to take part in the Promotion, or where information regarding their eligibility has been made available in another way via their account in the App;

4. have read these Terms and Conditions and accepted their provisions within the App before taking part in the Promotion;

5. has rented a power bank during the Promotion Period;

6. the User’s account balance in the VoltRush App is not negative;

7. is not currently renting a powerbank. 

1. Eligibility to take part in the Promotion is linked to the User’s individual account in the App and cannot be transferred to another account or to another person.

2. A User may take part in the Promotion once.

3. Merely holding an account in the App or meeting the criteria specified by the Organiser regarding previous use of the Service does not constitute grounds for the User to request eligibility to take part in the Promotion.

§ 4. Terms of use of the Promotion

1. As part of the Promotion, the User is entitled to a one-off, free-of-charge use of the Service for the Free Usage Period, i.e. a period of up to 24 hours calculated from the moment the powerbank covered by the Promotion is hired until the moment it is returned.

2. A powerbank rented as part of the Promotion must be returned correctly before the end of the Free Usage Period.

3. Participation in the Promotion is subject to the availability of powerbanks and the VOLTRUSH infrastructure enabling their hire and return. Granting the User the right to participate in the Promotion does not constitute a reservation of a specific powerbank nor does it guarantee its availability at the location chosen by the User.

4. Users eligible to take part in the Promotion will receive a push notification via the App informing them that they can take advantage of the Promotion.

5. In order to take advantage of the Promotion, the User should, upon receiving the message referred to in paragraph 5:

1. open the information regarding the Promotion within the App;

2. read these Terms and Conditions and accept their provisions by ticking the relevant box in the App;

3. during the Promotion Period, hire a powerbank via the App.

1. Taking part in the Promotion does not require the entry of a promotional code or the performance of any actions other than those specified in paragraph 5. Eligibility to participate in the Promotion is assigned directly to the User’s account in the App.

2. Upon the successful completion of the rental referred to in paragraph 6(3), the Free Usage Period referred to in § 2(3) of the Terms and Conditions shall commence.

§ 5. Rules for billing the Service

1. For the use of power banks in accordance with the rules of the Promotion during the Free Usage Period, the User shall not be charged for the rental period.

2. The Promotion covers only the charges for the duration of use of the Service during the Free Usage Period and does not exclude other charges, costs or the User’s liability which may arise in accordance with the Terms and Conditions of the Service, in particular in connection with the loss, destruction, damage or failure to return the powerbank.

3. The expiry of the Free Usage Period does not result in the automatic return of the power bank or the termination of the ongoing hire.

4. If, at the end of the Free Usage Period, the powerbank remains on loan to the User, continued use of the Service is subject to a charge. From the moment the Free Usage Period ends, charges for continued use of the Service are calculated in accordance with the VOLTRUSH price list applicable to the User and in accordance with the terms set out in the Terms and Conditions of the Service.

5. Taking advantage of the Promotion does not entitle the User to receive the equivalent of the unused Free Usage Period in cash or in the form of any other benefit.

6. The User is not entitled to a refund or equivalent in respect of:

   1. using only part of the Free Usage Period;

   2. failure to use the entitlement granted during the Promotion Period,

subject to the User’s rights under mandatory provisions of law.

§ 6. Combination with other promotions

1. The entitlement arising from this Promotion cannot be combined with other promotions, discounts or other special pricing terms relating to the rental fee for the same hire period, unless the terms of another promotion expressly state otherwise.

2. If the User is entitled to benefit from more than one promotion relating to the same hire, the promotion selected by the User shall apply or – if the App does not allow such a choice to be made – the promotion indicated to the User in the App prior to the hire.

§ 7. Complaints

1. The User may submit complaints regarding the conduct of a Promotion, charges incurred or the inability to exercise a granted entitlement in the manner provided for the submission of complaints in the Terms of Service, in particular via email: helpdesk@voltrush.pl

2. The complaint should contain information enabling it to be considered, in particular details allowing the User’s account to be identified and a description of the incident giving rise to the complaint.

3. The Organiser shall respond to a consumer’s complaint within 14 days of receiving it.

4. Failure to respond to a consumer’s complaint within the time limit referred to in paragraph 3 shall constitute acceptance of the complaint.

5. The provisions of this paragraph do not exclude or limit the User’s rights arising from mandatory provisions of law.

§ 8. Final provisions

1. Participation in the Promotion is voluntary.

2. These Terms and Conditions are made available to the User within the App prior to joining the Promotion, in a manner that allows the User to familiarise themselves with their content, as well as to save and retrieve them.

3. A condition of taking part in the Promotion is the User’s prior acceptance of these Terms and Conditions by ticking the box in the App stating: ‘I have read the Terms and Conditions of the “24 free” promotional campaign and accept its provisions.’

4. The Organiser may amend these Terms and Conditions during the course of the Promotion only for valid reasons, in particular in the event of:

   1. a change in the law affecting the rules governing the organisation of the Promotion;

   2. the need to comply with a final court judgement, a decision by a public administrative body or a binding recommendation by a competent authority;

   3. the need to introduce technical or organisational changes necessary for the proper or safe conduct of the Promotion,

provided that such changes do not infringe upon the rights acquired by Users or worsen the terms of the Promotion for Users who have already commenced their Free Usage Period.

1. The Organiser may terminate the Promotion before the end of the Promotion Period only for good cause, in particular in the event of technical, legal or organisational circumstances preventing the Promotion from continuing to be conducted properly. Early termination of the Promotion shall not affect the rights of Users who commenced the Free Usage Period prior to its termination.

2. In matters not covered by these Terms and Conditions, the provisions of the Service Terms and Conditions and generally applicable laws shall apply.

3. These Terms and Conditions shall come into force on 10 August 2026.
